Terms and Conditions

The terms that govern your access to and use of Bhoomee Store and its related services.

These Terms and Conditions govern your access to and use of the Bhoomee Store website, mobile application, online-ordering services and related services. Bhoomee Store is owned and operated by M5 Info Solutions Private Limited.

By accessing, registering with or placing an order through Bhoomee Store, you agree to these Terms and Conditions, the Privacy Policy and any other policy displayed on the platform. Please read them carefully before using the platform.

1. Acceptance of Terms

These Terms and Conditions govern your access to and use of the Bhoomee Store website, mobile application, online-ordering services and related services. Bhoomee Store is owned and operated by M5 Info Solutions Private Limited. By accessing, registering with or placing an order through Bhoomee Store, you agree to these Terms and Conditions, the Privacy Policy and any other policy displayed on the platform. Do not use the platform if you do not agree to these terms.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a contract to independently register, place orders or make payments. A person below 18 years of age may use the platform only under the supervision and responsibility of a parent or lawful guardian. You agree to provide accurate, current and complete information while registering and placing an order.

3. Bhoomee Store Business Model

Bhoomee Store operates through two principal divisions.

Partner Division

Independent fruit and vegetable retailers may be onboarded to:

  • procure fresh produce supplied through M5's sourcing network;
  • list or sell products through the Bhoomee Store platform;
  • accept and fulfil online orders in their local delivery area.

In such cases, the partner store may be the seller of record and may be responsible for invoicing, product preparation and local fulfilment.

Managed Division

M5 may directly operate:

  • franchise or collaborative retail outlets;
  • hybrid walk-in and online stores;
  • apartment-community stores;
  • other company-managed fresh-produce outlets.

In such cases, M5 or the identified operating entity may be the seller of record. The seller's name and relevant details should be displayed on the product page, checkout page, invoice or order confirmation, as applicable.

M5 remains available for platform-related grievances and will coordinate with partner stores where required.

4. Account Registration

You may be required to create an account using your name, mobile number, email address or OTP. You are responsible for:

  • keeping account credentials confidential;
  • protecting your mobile device and OTPs;
  • ensuring that information provided is accurate;
  • activities carried out through your account;
  • informing us promptly about unauthorised access.

We will never ask you to disclose your UPI PIN, card PIN, CVV, banking password or complete OTP through an unsolicited call or message. We may suspend or restrict an account where we reasonably suspect fraud, misuse, impersonation, unauthorised access or violation of these terms.

5. Product Information

We make reasonable efforts to display accurate information regarding:

  • product name;
  • product image;
  • approximate weight or quantity;
  • price;
  • seller;
  • availability;
  • delivery charges;
  • applicable taxes and fees.

Fruits and vegetables are natural and perishable products. Their colour, size, shape, ripeness, texture and appearance may vary from photographs displayed on the platform. Product images are generally illustrative and may not represent the exact item delivered.

6. Weight-Based Products

Certain products may be sold according to weight. Where final weight differs from the quantity initially selected:

  • the final charge may be based on the actual supplied weight;
  • any permitted variation should be reasonable and disclosed;
  • an excess amount collected should be adjusted or refunded;
  • a shortage should be appropriately reflected in the final invoice or refund.

The applicable unit of measurement, price and final quantity will be displayed on the invoice wherever relevant.

7. Product Availability and Substitution

Fresh-produce availability may change because of:

  • seasonal supply;
  • quality checks;
  • procurement conditions;
  • weather;
  • transportation delays;
  • unexpected demand;
  • store-level stock availability.

Where a product becomes unavailable after an order is placed, we may:

  • contact you for an approved substitute;
  • supply a lower quantity with a corresponding adjustment;
  • remove the unavailable product;
  • cancel the affected item and issue a refund.

We will not charge you for an unavailable product that is not supplied. A higher-priced substitute will not be supplied without your approval or an appropriate price adjustment.

8. Order Placement and Acceptance

Placing an order is an offer to purchase the selected products. An order is accepted only after it has been confirmed by Bhoomee Store or the fulfilling store. We may decline or cancel an order because of:

  • product unavailability;
  • incorrect pricing or product information;
  • delivery-address limitations;
  • payment failure;
  • suspected fraud;
  • unusually large or commercially unreasonable quantities;
  • technical errors;
  • events beyond our reasonable control.

Where payment has already been received for a cancelled order, the relevant amount will be refunded through the original payment method or another agreed method.

9. Prices, Taxes and Charges

Prices are displayed in Indian Rupees unless stated otherwise. The total amount payable may include:

  • product price;
  • applicable taxes;
  • delivery charge;
  • handling or packaging charge;
  • platform or convenience charge, where applicable;
  • other charges clearly disclosed before payment.

Charges will not be added after order confirmation unless they result from a customer-requested change. Prices and offers may differ between locations, stores, delivery areas and online or walk-in channels.

10. Payments

Available payment methods may include:

  • UPI;
  • debit or credit card;
  • net banking;
  • wallet;
  • cash on delivery;
  • other approved payment options.

Payment services may be provided by third-party payment processors. If an amount is debited but the order is not confirmed, the reversal or refund may depend on the processing timelines of the bank, card network, payment gateway or UPI provider. You must not use an unauthorised payment instrument or payment account.

11. Delivery

Delivery is available only in selected locations and generally within the service radius of the relevant partner or managed store. Delivery times shown on the platform are estimates. Actual delivery may be affected by:

  • traffic;
  • weather;
  • product availability;
  • apartment-entry restrictions;
  • incorrect addresses;
  • customer unavailability;
  • operational or technical issues;
  • events beyond reasonable control.

You are responsible for providing:

  • a complete delivery address;
  • a reachable mobile number;
  • correct apartment, block and unit information;
  • necessary access instructions.

Where delivery cannot be completed because the address is incorrect, the customer is unavailable or entry is denied, additional delivery charges may apply or the order may be cancelled subject to the refund policy. Risk in the products passes to the customer upon successful delivery.

12. Inspection at Delivery

Customers are encouraged to inspect the order promptly after delivery. Any complaint involving:

  • missing products;
  • incorrect products;
  • damaged products;
  • spoiled or unusable produce;
  • significant quality concerns;
  • material weight differences

should be reported within 4 hours of delivery through the application, website or customer-support channel. Customers may be asked to provide:

  • order number;
  • product details;
  • photographs or videos;
  • a brief description of the concern.

The reporting period should be reasonable considering the perishable nature of the products and does not remove statutory consumer rights.

13. Cancellation Policy

An order may ordinarily be cancelled without charge before the store begins picking, packing or dispatching it. After preparation or dispatch has started, cancellation may not be possible because fresh produce is perishable. Bhoomee Store may nevertheless permit cancellation in exceptional circumstances at its discretion or where required by law. Where Bhoomee Store or the seller cancels an order, the customer will receive a refund for the cancelled products and applicable charges.

14. Refund and Replacement Policy

A refund, replacement or credit may be provided where:

  • the wrong product was delivered;
  • a paid product was missing;
  • the product was damaged at delivery;
  • the produce was spoiled or unfit for normal use at delivery;
  • the supplied quantity materially differed from the invoiced quantity;
  • the order was cancelled after payment;
  • the seller was unable to fulfil the order.

Depending on the circumstances, we may offer:

  • replacement;
  • refund to the original payment method;
  • refund to an approved wallet;
  • Bhoomee Store credit;
  • adjustment against a future order.

A wallet or store credit will not be imposed instead of a monetary refund where a monetary refund is required by law or where the customer has not agreed to receive credit. Refund processing may take 5 to 10 business days after approval, depending on the payment provider and bank.

A refund may be declined where:

  • the issue results from improper storage after delivery;
  • the product has been substantially consumed or disposed of without evidence;
  • the complaint is unrelated to the condition at delivery;
  • false or misleading information has been provided;
  • the request is fraudulent or abusive.

Nothing in this section limits rights available to consumers under applicable law.

15. Storage and Consumption

Customers should:

  • inspect produce before use;
  • wash fruits and vegetables appropriately;
  • store products according to their nature;
  • refrigerate perishable products where required;
  • consume products within a reasonable period.

Bhoomee Store is not responsible for deterioration caused by improper handling or storage after delivery.

16. Offers, Coupons and Bhoomee Points

Promotions, coupons, discounts and Bhoomee Points may be governed by additional conditions displayed with the relevant offer. Unless otherwise stated:

  • offers cannot be exchanged for cash;
  • offers may be limited by location, store, product or customer;
  • only one coupon may be permitted per order;
  • benefits obtained through fraud or misuse may be withdrawn;
  • points may expire after the validity period displayed in the customer account;
  • cancelled or refunded orders may result in reversal of earned points.

Any expiry period and material restrictions will be communicated clearly.

17. Customer Reviews and Content

Customers may be allowed to submit reviews, ratings, photographs and feedback. You agree not to submit content that is:

  • false or misleading;
  • defamatory;
  • obscene or abusive;
  • discriminatory;
  • unlawful;
  • infringing another person's rights;
  • unrelated to the product or service;
  • promotional spam;
  • malicious software or harmful code.

You retain ownership of original content submitted by you but grant Bhoomee Store a non-exclusive, royalty-free licence to display and use it for platform, service-improvement and promotional purposes, subject to applicable privacy law. We may remove content that violates these terms.

18. Prohibited Activities

You must not:

  • use the platform for unlawful purposes;
  • create false accounts;
  • impersonate another person;
  • manipulate prices, orders, reviews or promotional benefits;
  • attempt unauthorised access to systems or data;
  • introduce malware or harmful code;
  • scrape or copy platform information without permission;
  • interfere with website or application operations;
  • abuse customer-support personnel, store employees or delivery personnel;
  • make fraudulent refund or replacement claims;
  • resell products commercially without written approval.

19. Intellectual Property

The Bhoomee Store name, logo, website, application, software, graphics, designs, content, databases and other platform materials are owned by or licensed to M5 Info Solutions Private Limited. You may use the platform only for personal and lawful purposes. No content may be copied, reproduced, modified, distributed, sold or commercially exploited without prior written permission, except where permitted by law. Third-party names, logos and trademarks belong to their respective owners.

21. Platform Availability

We aim to keep the platform available and functional but do not guarantee uninterrupted or error-free access. The platform may be temporarily unavailable because of:

  • maintenance;
  • technical failures;
  • network disruptions;
  • security incidents;
  • software updates;
  • events beyond our control.

We may modify, suspend or discontinue a feature after considering customer orders and outstanding obligations.

22. Disclaimer

Bhoomee Store will make reasonable efforts to maintain accurate product information, reliable fulfilment and appropriate quality standards. However, to the extent permitted by law:

  • availability is subject to daily supply;
  • natural produce may vary in appearance;
  • delivery estimates are not guaranteed;
  • third-party payment and communication services may experience interruptions;
  • partner stores remain responsible for information and products supplied by them, subject to Bhoomee Store's platform and grievance responsibilities.

Nothing in these terms excludes responsibility that cannot legally be excluded.

23. Limitation of Liability

To the extent permitted by law, Bhoomee Store and M5 will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable. For claims relating to a specific order, liability will ordinarily be limited to the amount paid for the affected product or order, except where a higher liability is required under consumer-protection, product-liability or other applicable law. This limitation does not apply to fraud, wilful misconduct, gross negligence or any liability that cannot legally be limited.

24. Indemnity

You agree to compensate M5 for reasonable losses, costs or claims directly resulting from:

  • your unlawful use of the platform;
  • your fraudulent conduct;
  • your material breach of these terms;
  • your infringement of another person's rights.

This provision does not apply to losses caused by M5, its employees, authorised representatives or sellers.

25. Suspension and Termination

We may suspend or terminate access where a user:

  • violates these terms;
  • commits or attempts fraud;
  • misuses offers or refunds;
  • threatens platform security;
  • repeatedly abuses employees, partners or delivery personnel;
  • uses the platform unlawfully.

Where appropriate, we may provide notice and an opportunity to respond. Suspension will not affect pending refunds or statutory consumer rights.

26. Force Majeure

Bhoomee Store will not be responsible for delay or failure caused by events reasonably beyond its control, including:

  • floods or severe weather;
  • natural disasters;
  • epidemics;
  • strikes;
  • government restrictions;
  • transport interruptions;
  • market closures;
  • power or network failures;
  • civil disturbances;
  • supply-chain disruptions.

We will take reasonable steps to communicate material delays and provide refunds where an order cannot be fulfilled.

27. Governing Law and Disputes

These terms are governed by the laws of India. Customers should first contact our Grievance Officer so that we can attempt to resolve the issue directly. Subject to rights available under consumer-protection law and the jurisdiction of competent consumer commissions, courts in Bengaluru, Karnataka will have jurisdiction over disputes relating to these terms. Nothing in these terms prevents a consumer from approaching a competent consumer commission or another authority available under applicable law.

28. Changes to the Terms

We may update these terms to reflect changes in services, operations, law or technology. The revised terms will be posted with an updated effective date. Material changes may be communicated through the website, application, email, SMS or another appropriate method. Changes will not unfairly alter orders already accepted unless required by law or agreed with the customer.
